By doing any of the following acts you agree to be bound by these Terms and Conditions and you expressly accept these terms and conditions at any time, for example by:

  • clicking “I Accept” or “Proceed” or any clearly indicated activation phrase on your computer or other device; or
  • downloading any of our digital applications (App) or any upgrade to an App offered from time to time; or
  • using the website; or
  • attending any classes at our studios; or
  • participating any of our digital class content; or
  • purchasing any items from our ecommerce store.

Bodhi and Ride Digital Pty Ltd (“us”, “our”, “Bodhi at Home”, or “we”) provides this web site to you under the following terms and conditions (“Terms of Use”).

License

We grant you a limited, non-exclusive, non-transferable license to view content on the Site for personal, non-commercial purposes.

We reserve the right to terminate or limit your access to the Site and/or the licenses granted herein for any reason and in our sole discretion. You agree not to modify, damage, disrupt, disable, overburden, impair, alter or interfere with the use, features, functions, operation, security or maintenance of the Site or the rights or use and enjoyment of the Site by any other person or entity in any manner.

You are prohibited from transmitting any material on or through the Site that, in our sole opinion, is or could be offensive, fraudulent, unlawful, threatening, libellous, defamatory, obscene, scandalous, inflammatory, pornographic or profane, or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law. This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from us. 

This website with URL address https://www.bodhiandride.com.au is owned and operated by Bodhi and Ride Australia Pty Ltd, ABN 96629883898 and its associated companies.  It offers the products and services described, including Bodhi and Ride, Ride classes, other fitness classes and related activities and products (the “Services”). 

Should you continue to use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern Bodhi & Ride Pty Ltd’s relationship with you in connection with this website. Should you not agree with any of these terms and conditions, please do not use our website.

As explained below, we collect information from you and other visitors and users (collectively, “you”, “your”, or “users”) of our website in various ways when you interact with our website (collectively, the “Site”), including, for example, registering for the Services, visiting or browsing through the Site for other purposes, or participating in or using any Service. By using our Site and/or Services and providing any information to us through the same, you consent to our collection and use of information as explained in this Privacy Policy and agree to be bound by our Terms of Use.

Governing Law

This Privacy Policy shall be governed by, construed and entered in accordance with the laws of Australia.

Personal information we collect

When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”.

We collect Device Information using the following technologies:

  • “Cookies” are data files that are placed on your device or computer and often include an anonymous unique identifier. For more information about cookies, and how to disable cookies, visit http://www.allaboutcookies.org.

Additionally when you make a purchase or attempt to make a purchase through the Site, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, email address, and phone number. We use the Order Information that we collect generally to fulfill any orders placed through the Site (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations). Additionally, we use this Order Information to:

  •  When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.

Transaction email 

When you first register with us, we may send you a welcome email that provides information about the Services and your account. If you make a Purchase, we may send you an email confirming your Purchase. We may also, from time to time, send you other emails concerning your account status. You may not opt-out of receiving transactional emails.

Newsletters: We may send you newsletters and other emails about new or upcoming services, or offers. If you decide you no longer wish to receive these emails, you may opt-out as instructed in each email or in your account settings.

Fraud detection

We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).

Sharing you personal Information

We share your Personal Information with third parties to help us use your Personal Information, as described above. As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. Do not track

Please note that we do not alter our Site’s data collection and use practices when we see a Do Not Track signal from your browser.

 

Data retention

When you place an order through the Site, we will maintain your Order Information for our records unless and until you ask us to delete this information.

Minors

  • The Site is not intended for individuals under the age of 16. All orders placed by minors require the consent of a parent or guardian. 
  • In order to attend a class at one of our studios, those under 18 years of age must have a form signed by a parent or guardian on arrival at the studio.

Changes to Our Privacy Policy

We reserve the right, in our sole discretion, to change, modify, add, or remove this entire Privacy Policy, or any portion of it, at any time. Any changes or updates will be effective immediately upon posting to our Site, and we will make reasonable efforts to send to you at the email address that you provided a notice informing you that we have updated this Privacy Policy. Notwithstanding that, you should review this Privacy Policy regularly for changes, and can determine if changes have been made by checking the Effective Date below. Your continued use of our Site or Services following the posting to the Site of any changes to this Privacy Policy means you accept and consent to such changes.

Your Account

 If you use the Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that the Company is not responsible for third party access to your account that results from theft or misappropriation of your account. The Company and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content at our sole discretion.

The Company does not knowingly collect, either online or offline, personal information from persons under the age of thirteen (13). If you are under sixteen (16) years of age, you are prohibited from using this website. By providing information about yourself, you represent that you are eighteen (18) years of age or older.

By creating an account, you represent: (a) that you are at least eighteen (18) years old; (b) you will maintain the confidentiality and security of any account credentials; (c) you are creating an account on your own behalf (or on behalf of another for which you are authorized to act); and (d) all required registration information is truthful and accurate, and you shall maintain the accuracy of such information.

The Company reserves the right to access your account and content in order to respond to requests for technical support, to maintain the safety and security of the Company Site, and for other legitimate business purposes, as necessary, in the Company's discretion. 

Data Policy

By agreeing to these terms and conditions you agree to automatically be signed up to Bodhi & Ride’s email newsletter. You are able to unsubscribe from this newsletter at any time by clicking the ‘unsubscribe’ link within the newsletter.

Unsolicited Communications

You agree that any information that you transmit to the Site or us in any manner, is non-confidential and non-proprietary and can be used by us for any purpose. We are free to use any idea, concepts, know-how, techniques, etc. contained in any communication to the Site for any purpose.

Disclaimer of Liability

Your use and browsing in the Site are at your own risk. Neither we nor any other party involved in creating, producing, or delivering the Site shall be liable for any direct, incidental, consequential, indirect or punitive damages arising out of your access to, or use of, the Site. Without limiting the foregoing, everything on the Site is provided to you “as is” without warranty of any kind, either expressed or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Please note that some jurisdictions may not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you. Check your local laws for any restrictions or limitations regarding the exclusion of implied warranties.

We assume no responsibility for, and shall not be liable for, any damages to or viruses that may infect, your computer equipment or other property on account of your access to, use of, or browsing in the Site or your downloading of any materials, data, text, images, video, or audio from the Site.

We reserve the right to remove any content from the Site or to restrict access to the Site for any reason without notice.

 Indemnification

You agree to indemnify, defend and hold us and any of our affiliates, and any of our or their successors and assigns, and any of their respective officers, directors, employees, agents, representatives, licensors, advertisers, suppliers, and operational service providers harmless from and against any and all claims, actions, losses, expenses, damages and costs (including reasonable attorneys' fees), resulting from any breach or violation of these Terms of Use by you or arising from your use of the Site.

We reserve the right to assume, at our sole expense, the exclusive defence and control of any such claim or action and all negotiations for settlement or compromise, and you agree to fully cooperate with us in the defence of any such claim, action, settlement or compromise negotiations, as requested by us.

These Terms of Use contain the entire understanding between you and us relating to the Site and our services.

If you sign up to a class, workshop or consultation at Bodhi & Ride, you agree to the following liability and indemnity clause: 

I understand that Bodhi & Ride classes include physical activity.

As is the case with any physical activity, the risk of injury, even serious or disabling, is always present and cannot be entirely eliminated. I agree to listen carefully and follow the teachers’ instructions at all times, and to ask the teacher to clarify any direction if I do not understand. If I experience any pain or discomfort, I will listen to my body, discontinue the activity, and ask for support from the instructor. I will continue to breathe smoothly. I assume full responsibility for any and all damages, which may incur through participation.

I understand that Bodhi & Ride classes are not substitutes for medical attention, examination, diagnosis or treatment.

Bodhi & Ride classes are not recommended and are not safe under certain medical conditions such as epilepsy, pregnancy, or spinal injuries. By signing, I affirm that a licensed physician has verified my good health and physical condition to participate in such a fitness program.

In addition, I will make the instructor aware of any medical conditions or physical limitations before class. If I am pregnant, become pregnant or I am post-natal or post-surgical, my signature verifies that I have my physician’s approval to participate. I also affirm that I alone am responsible to decide whether to engage in classes at Bodhi & Ride and participation is at my own risk. I hereby agree to irrevocably release and waive any claims that I have now or may have hereafter against Bodhi & Ride and all related facilities and premises for any personal injury or negligence. Additionally, the facility, instructor and Bodhi & Ride are not in any way responsible for any loss or damage of your personal property. I understand that I may receive physical assists or adjustments to enhance or correct my body posture during Bodhi & Ride classes by either the teacher or an assistant in class. I will take accountability for alerting the teacher or assistant if I do not want to receive any adjustments. I will also take accountability for alerting the teacher or assistant of any injury or impairment in advance of them adjusting me.

I warrant that I am in good physical condition and am unaware of medical or other reasons why I cannot or should not do active or passive exercise.

I recognise that the fitness instructor(s) is not able to provide me with medical advice with regard to my fitness and that this information is used as a guideline to the limitations of my ability to exercise. I agree to not hold any certified trainer or directors of Bodhi & Ride Pty Ltd and its associated companies liable for any injury and/or illness that may occur during a Bodhi & Ride session.

I have carefully read and fully understand and agree to the above terms of this Liability Waiver Agreement. I am agreeing to this agreement voluntarily and recognise that my agreement serves as complete and unconditional release of all liability to the greatest extent allowed by law and that it cannot be changed orally.

 If any portion of this release from liability shall be deemed by a Court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.

By accepting these terms, I assume any risk and take full responsibility and waive any and all claims of personal injury, damage to personal property and death relating to all activities associated with indoor cycling classes and other fitness classes that Bodhi & Ride may be offering.

On behalf of myself, my heirs, assigns, and next of kin, I waive all claims for damages, injuries, and death sustained by my property or me.

Studio Operation Policy

Every possible effort will be made to deliver classes and services on time as advertised. However the schedule is subject to change or cancellation without notice.

We will refund, transfer or offer compensation of any kind for classes that are late, changed or cancelled for any reason by us.

The door to the studio may be locked at the beginning of each class for safety and security. Late entry will not be permitted and it is your responsibility to arrive at the studio at least 10 minutes before the start of a class.

We are not responsible for the safekeeping of your belongings. We advise that you should store any belongings in the lockers, at your own risk.

We reserve the right to refuse entry at any time and cancel memberships.

We do not allow any derogatory or abusive behaviour directed towards other customers or staff at our studio, via any channel of communication.

Bodhi & Ride Digital e-commerce/Shop Terms and Conditions

Our Bodhi shop refers to our online e-commerce platform that allows us to sell our products and services to you. 

Online Store terms of service:

  • By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site. 
  • You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). 
  • You must not transmit any worms or viruses or any code of a destructive nature. 
  • A breach or violation of any of the Terms will result in an immediate termination of your Services. 
  • We reserve the right to refuse service to anyone for any reason at any time. 
  • You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. 
  • You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us. 
  • The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms. 

Modification of our services

Prices for our products are subject to change without notice. 

We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. 

We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service. 

 Products or Services

Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy. 

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate. 

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. 

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. 

Accuracy of billing and account description 

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.  

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

Returns Policy for Bodhi Shop

Bodhi and Ride have no problems if you want to return an item.

  • You can return any garment for a full refund if it is within 7 days of receiving your original order. To start an online return, please contact hello@bodhiandride.com.au
  • We do not accept change of mind returns on clearance or discounted items
  • The amount refunded will be the price paid when purchasing the item, minus any incurred delivery, processing or postage fees.
  • Return parcels are paid for at the customers own expense.
  • International orders may be returned using any method of your choice, at your expense. We recommend using a traceable and insured service
  • Refunds for international customers will occur once the goods are received
  • It is a legal requirement that Bodhi and Ride declare the full value of goods (not including shipping charges) on all packages delivered outside of Australia. Shipments may be subject to import duties and taxes which are levied once a shipment reaches your country
  • It is a criminal offence to falsify the details on this form. We cannot inaccurately describe the contents, claim a lower value or mark as a gift. Please do not ask us to do any of the above
  • Any additional charges or fees for customs clearance must be covered by you. Unfortunately we have no control over these charges and cannot predict what they may be. We are unable to reimburse any costs incurred regardless of the circumstances
  • Please make sure you return the goods in the same condition you received them in. We are happy and willing to accept all garments returned, however, if they arrive in a poor condition we might have to send them back to you
  • The goods are your responsibility until they reach our warehouse, so please make sure they are packed securely so they do not get damaged. Please also ensure you send the goods with a tracking number, otherwise we will not take responsibility if the goods never arrive back with us.

Optional tools  

  • We may provide you with access to third-party tools over which we neither monitor nor have any control nor input. 
  • You acknowledge and agree that we provide access to such tools ”as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. 
  • Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). 
  • We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or services shall also be subject to these Terms of Service.

We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Bodhi & Ride Digital payment Terms and Conditions

Payments Policy

Bodhi and Ride accept the following methods of payment:

  • Visa
  • MasterCard
  • PayPal
  • Apple Pay

Shipping and Handling

  • Dispatch time: All orders will be dispatched from our warehouse within 3 working days using the Australia Post eParcel service or similar when shipping in Australia. Please allow up to 5 working days during a New range release or a Sale.
  • Shipping Time: Within Australia: 4-7 working days (Allow up to 10 working days during a sale).

BODHI & RIDE MEMBERSHIPS - TERMS AND CONDITIONS

Before you commit to one of our memberships, please ensure you read the terms and conditions outlined below. Your membership purchase confirms that you accept the terms and conditions below, and a copy of these will also be linked in an email sent to you upon signing up.  

Studio Membership Options

Please note: All membership credits can be used for Ride, Strength and Flow classes unless specified otherwise.

OLD STUDIO MEMBERSHIPS. NO LONGER AVAILABLE FOR PURCHASE.

Minimum commitment of 6 months. 

Monthly billing. Monthly booking window.

  • Foundation Membership: $150 per month for 6 credits per month. 
  • Rockstar Membership: $240 per month for 15 credits per month.
  • Tribe Membership: $200 per month for 10 credits per month.
  • Off Peak Membership: $160 per month for 10 credits* per month.
    *Only valid for: Monday-Friday rides, mornings/am and lunchtime rides only.
  • Student Membership*: $180 per month for 10 credits per month.
    *Please email a copy of your student ID to home@bodhiandride.com.au so we can update your account as being eligible for student pricing. If you have not sent us a copy of your student ID we may ask to see it at the studio when you check in for a class booked with student pricing. Student pricing is for local students only as we do not accept international student IDs.
  • Unlimited Membership*: $239 per month for unlimited credits per month. Price may vary depending on the sign up date.
    *Unlimited membership is not currently available for purchase.
  • Sweat and the City Membership: $69 per week for 30 credits per month (15 Ride only credits + 15 Strength/Flow only credits). CBD location only. Minimum commitment of 3 months.Monthly billing. Weekly booking window.

  • Sweat Membership: $40 per week for 2 credits per week. 
  • Thrive Membership: $60 per week for 4 credits per week.
  • Elevate Membership: $69 per week for 7 credits per week.
  • Student Membership*: $45 per week for 3 credits per week.
  • *Please email a copy of your student ID to home@bodhiandride.com.au so we can update your account as being eligible for student pricing. If you have not sent us a copy of your student ID we may ask to see it at the studio when you check in for a class booked with student pricing. GENERAL MEMBERSHIP TERMS AND CONDITIONS:

 

1. Class Access 

  • You can book into any class at any of our 3 studios.
  • Exclusions: Membership credits are not valid for workshops and events held at Bodhi & Ride or at outside venues eg.Pop ups or Bodhi Open Air RIDES.

2. Membership Payments

  • Studio membership fees are billed either monthly or weekly, depending on the type of membership on your account. 
  • All current studio memberships are sold on a per-month basis. Your membership payment will be on the same date each month.
  • Bodhi at Home Membership fees are paid monthly, at the start of your membership billing month unless stated and agreed upon otherwise.
  • You agree to payment for the full minimum term. The minimum term is also called the minimum commitment period. The minimum terms depend on which membership you sign up for.  
  • If no start date is manually selected for your membership, the membership will start on the day of purchase and not on the first class booked.
  • If you cannot use all of your allocated amount of membership’s allocated ride credits within the billing period, any unused credits will expire.
  • Memberships cannot be cancelled before the minimum commitment terms is over, or transferred to other members.
  • Membership payments are processed via direct debit or credit card.
  • A valid card needs to be on file.
  • If your card payment fails you will be charged a $10 fee for each failed transaction.
  • Your membership will continue to renew even after the minimum term is over. To stop your payments you need to cancel your membership after the minimum term is over.
  • We do not offer any refunds of unused membership credits or any membership payments. 
  • Depending on the membership you are on, a joining fee may apply. 
  • You must meet your payment responsibilities by ensuring that there is enough money in your account on the payment day and tell us about any changes to your credit card, such as its expiry date or number, at least 72 hours before your next debit.

3. Membership Non-Payments

  • If there is non-payment of a Membership, we will pass your details to a collection agency.
  • We may apply taxes, including GST to any charges. Prices and other terms of purchase are subject to change. 
  • You will pay to us any and all of our expenses including any legal costs (on an indemnity basis) and other expenses payable under these Terms and Conditions together with any debt collection costs (on an indemnity basis) incurred:
  • as a result of, or in connection with, a default by you under these Terms and Conditions; or
  • in connection with the enforcement or attempted enforcement of, or preservation of any rights, under these Terms and Conditions; and
  • and such costs and other expenses may be recovered by us from you as a liquidated debt. Any payments received by us from you shall be applied firstly to any legal costs, collection costs and other expenses, then to interest and the remainder to the balance of monies owed by you.

4. Membership Cancellation

  • To cancel a membership, please submit this form located at https://form.typeform.com/to/O5O90jxK (you may need to copy and paste that into your browser) 
  • Memberships can be cancelled once you have completed the minimum term of commitment by giving us at least 2 weeks notice. 
  • If your next payment is due within that 2 weeks, you will be required to pay that next fee before cancellation can occur.
  • You can not request a membership cancellation while a membership is paused.

6. Membership Switches 

  • You can only switch your membership by submitting this form: tinyurl.com/membership-switch  (you may need to copy and paste that into your browser) 
  • Once the form has been submitted, 3 business days notice is necessary to action a membership switch
  • You can only switch memberships once
  • You cannot transfer a membership to another person.
  • When you switch a membership, the minimum commitment period applies again to the new membership. 
  • A $25 membership switching fee applies.

7. Membership Pauses 

To pause an At-Home membership: we are unable to pause at-home memberships.

To pause a Membership from your next billing date to billing date:

  • Go to ‘my account’
  • Select 'manage subscription'
  • Click ‘pause’.

Please note:

  • You can pause a membership for a maximum of 4 times per year* (max 1 billing period each time) if you are away, unwell or busy at work.
  • Your membership cannot be un-paused early.
  • While a membership is paused, we can not amend the period for which it is paused ie the pause cant be extended or shortened. If you need extra time for a pause, the membership has to un-pause itself first before any further changes can be made.
  • While your membership is paused, you will not be able to book any classes, and our team can also not help you with this (sorry). If you wish to attend classes before your membership restarts, you can purchase member top credits available on the 'buy' page, or simply wait for the pause to finish and the membership to be active again. 

  • Please note: Membership pauses do not count towards the 2 x week notice period required for membership cancellations: ie you can't pause the membership, and then email to say we should cancel the memberships all together while it's paused.

8.  Impact on Membership by Pandemic 

  • Due to the outbreak of COVID-19 virus, Bodhi & Ride must follow a COVID SAFE plan to create a safe environment to minimise the risk of exposure. You agree to abide by these regulations and will disclose if you are presenting symptoms of COVID-19 or have been directed to self isolate for any other reason. Please note that in the event of a studio shutdown, all studio memberships will be automatically suspended and all studio membership credits will be frozen until the studio reopens.
  • Fee increases and change of terms: Bodhi & Ride  reserve the right to amend membership fees and terms at any time during your agreement. Bodhi & Ride will make a reasonable effort to tell you about this at least 14 days beforehand via email. No fee change for terms changes will be implemented unless we receive your consent to such changes via email.

9. Studio: Refunds, No Shows and Late Cancellations

  • We have a 12 hour cancellation policy. 
  • We are unable to refund classes if you fail to show up to a class you’ve booked.
  • However, in the event that you cancel out of a class within our cancellation policy (12 hours prior to class start time), we will put the class credit back on to your account. 
  • If you don't cancel your booking at least 12 hours prior to class start time, a $20 no show fee applies for the following cases:
    •  Anyone on an Unlimited membership booked into Ride, Strength or Yoga.
    • Anyone on a Challenge pack booked into Ride, Strength or Yoga.
    • All Strength or Yoga bookings, whether on a Membership or Class Pack.
    • Fees are automatically applied to your account.

      10. Studio: Waitlist Terms 

      • When you add yourself to a class waitlist, you'll receive an email confirming your spot on the waitlist.
      • If a spot becomes available, you'll receive an email and automatically* be added into the class.
      • Exceptions: If a spot becomes available with less than 3 hours to go before class start time or between the hours of 10pm and 6am, we understand that you may no longer be able to make it due to short notice or being asleep. Therefore, you'll instead receive an email to let you know a spot is available and you'll have the choice to manually book yourself into the class.

      BODHI & RIDE CLASS PACKS AND CREDITS - TERMS AND CONDITIONS

      Before you commit to one of our class packs or class credits, please ensure you read the terms and conditions outlined below. Your class pack or credit purchase confirms that you accept the terms and conditions below, and a copy of these will also be linked in an email sent to you upon purchase.  

      Class Credit Policy:

      When you purchase class credits from Bodhi & Ride, you agree that this credit can only be used by yourself and is not transferable to another member unless you get approval from our team.

      Please note that all class packs and credits activate on the day of purchase and are valid for the period as outlined on our pricing page. We are unable to extend the validity of any class credits due to system imitations.

      • $60 for 4 credits that expire 21 days after purchase. 
      • 3 Credits are valid for Ride, Strength and Yoga classes.

        Class Pack and Credit Refunds and Transfers

        •  Your class pack or credits are non refundable and cannot be extended beyond the validity date.

        • If you become injured or change your mind after purchasing a class pack or credit, we cannot offer you a refund, but you can transfer the class pack to a friend or family member. Email home@bodhiandride.com.au to do so.

        • Rebooking and extending a credit may only be used once per customer.

          • We are not required to provide a refund or replacement if you change your mind. Please note all purchases are non-refundable, non-transferable and non-extendable.

Bodhi & Ride will make a reasonable effort to tell you about this at least 14 days beforehand via email. No fee change for terms changes will be implemented unless we receive your consent to such changes via email.

          Bodhi & Ride Digital ‘At home’ Terms of Use

          Program viewing, subscriptions and memberships:                     

          • The Producer may add or remove Programs from the channel at any time.
          • You are responsible for obtaining Internet access and a compatible, Internet-connected device to stream and/or download Programs via Producer websites and applications. The quality of your viewing experience depends on a number of factors, including your viewing device and the quality of your Internet connection.

          Device suitability

          Bodhi at Home makes no representations or warranties concerning:

          • The availability of Bodhi at Home for any particular device, operating system, or browser.
          • The continued support for a particular feature of Bodhi at Home.
          • he viewing quality of any Program.
          • Bodhi at Home does not guarantee that you will be able to view any Program uninterrupted or error-free.
          • The continued availability of any Program or the availability of particular Program within a subscription channel.

          Acceptable Use Policy

          In using the Bodhi Digital Service, you will not:

          • Scrape, reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer, or disassemble content or any source code therein;
          • Attempt to circumvent any technical measures (including digital rights management) that we may employ;
          • Take any measures to interfere with or damage Bodhi at Home;
          • Use Bodhi at Home to transmit tortious, unlawful, infringing, and otherwise objectionable content;
          • Spam or harass any user;
          • Use any fraudulent, deceptive, or misleading practices;
          • Collect personal information about any users;
          • Engage in any commercial activities except as permitted by us; or
          • Engage in any illegal activities.

          Intellectual Property

          License to Programs: Subject to the terms hereof, you have the right to stream and/or view programs for your personal entertainment purposes: (i) Programs that you have rented during the stated rental period; (ii) Programs that you have purchased; and (iii) Programs made available within a channel that you have subscribed to during your subscription period.

          You may not resell streams or downloads, use any Program for any commercial purpose, redistribute or retransmit any Program, publicly perform or display any Program, or make derivative works from any Program.

          If you download an application that we power (an “app”) that operates on a third party platform (e.g., iOS, Roku): (i) you have the right to use such app for your personal, non-commercial use on devices permitted by the platform operator; (ii) as between Bodhi at Home and the platform operator (but without creating any obligation by Bodhi at Home), Bodhi at Home shall be responsible for the apps and their content and providing any warranty, support, or indemnification with respect to such apps as required by law; and (iii) the platform operator shall have the right to enforce the terms of this clause with respect to your use of the app.

          Bodhi & Ride Equipment Hire Terms of Use 

          • A $50 delivery fee may apply 
          • The hirer assumes all responsibility for the equipment whilst the equipment is out of the possession of the owner, Bodhi & Ride.
          • The hirer acknowledges that the equipment is the property of the owner and that at times of delivery of the equipment from the premises of the owner the equipment was in good and correct working condition and repair.
          • The hirer will return the equipment to the owner in good condition equal to that in which it was delivered and the hirer shall be responsible for the cost of such repairs or reinstatement of the equipment as may reasonably be required to bring it back to such condition.
          • The equipment shall be returned as supplied by the hirer.
          • In the event that the equipment is lost, stolen or otherwise misplaced or destroyed or damaged beyond economic repair for whatever reason and in whatever circumstances the hirer shall pay to the owner on demand the current retail replacement price for the equipment as at the date of the demand. Please note: The RRP of each bike is $2,000.
          • Unless otherwise agreed, the hirer shall pay in addition to rental charges and any other sums due under the terms of this agreement all and any cartage, transport or like expenses or charges incurred in the transport of the equipment from the owner to the hirer, and the recovery by the owner of the equipment and the return of the equipment to the premises of the owner.
          • Rental is payable from the date the equipment leaves the premises of the owner and continues to be payable until the date the equipment is received back at the premises of the owner on completion of hire. 
          • In the event of theft, loss, destruction or damage beyond economic repair rental continues to be payable by the owner until the date of payment by the owner to the hirer in full of the replacement cost. Where repairs, restitution or the like are required to bring the equipment into its pre-hire condition the hirer shall remain liable for payment of rental until such time as such repairs, restitution or the like are completed and the equipment is brought back to its pre-hire condition.
          • The hirer agrees to observe and be bound by the conditions of hire hereunder.
          • The hirer agrees to pay all sums due hereunder for rental, replacement, repair, cleaning or making good promptly on the due date. In the event of any default or delay in payment by the hirer the hirer shall in addition to all other sums payable hereunder pay to the owner all collection fees, legal fees, court costs, transport or salvage charges, costs and fees incurred in relation to recovery of possession by the owner and all other expenses incurred by the owner in enforcing the terms of this agreement.

          Delivery and removal of the equipment:

          • In the event of failure by the hirer to return the equipment at the end of the hire period or on termination of the hire the owner may enter on any property where the equipment is situated so as to take possession of same and the hirer hereby indemnifies the owner from all claims by any persons (including the hirer) resulting from such entry and retaking of the equipment.

          Hire Start Date and Hire Period: 

          • Hire commences on the date stated on the agreed hiring start date, which is the same day the bike will be delivered to your home. 
          • Unless otherwise agreed, the hire agreement goes for an initial period of 4 weeks with subsequent hire being available on a monthly basis or rolling weekly basis if otherwise stated and agreed upon 
          • Where delivery takes more than 2 days, the hire period will commence on the date of arrival at the hirer’s premises.

          At Home Membership termination:

          • To cancel a bike hire membership, go to ‘my account’, select 'manage subscription' and click cancel. From there you will be prompted to contact us and we will be in touch.
          • If your next payment is due within that two weeks, you may be entitled to pay that next fee before cancellation can occur.
          •  Memberships can be cancelled once you have completed the minimum term of commitment by giving us at least 2 weeks notice. 

          Hire Returns: 

          • In the case of return, the hirer will confirm arrangements with the owner for the return of the equipment. There is no refund on any unused hire period.
          • The hirer shall contact the owner giving at least 1 week notice if the hirer wishes to return the equipment. Unless advised, the hirer will continue hiring the equipment.
          • A mutually agreeable time for return and pick up must be agreed upon between the two parties. 
          • Hire period or returns in case of a lock-down: in case there is a Government imposed lock-down which restricts the movement of people and equipment, the hirer is required to pay for hire fees until the lock down is over.
          • Hiring charges: The upfront hire charges payable by the hirer to the owner shall be the applicable fee as agreed. 

           

           

          Hire Payments:

          • Payment shall be made in advance of the dispatch of any goods via credit card. After the initial hire period. A valid credit card needs to be available from which the charges will be deducted. In the event that a card payment fails. A re-charge fee of $10 will be applied for each failed payment.

          Care of equipment and breakdowns:

          • The hirer shall take due and proper care of the equipment and shall maintain service, store and use the equipment in accordance with manufacturer’s specifications and recommendations and the owners guidelines. 
          • At the start of the hire and upon delivery of the equipment, the owner will show the hirer how the equipment is to be maintained.

          Further Hire Terms of Use:

          • The hirer shall take proper care of the equipment
          • The hirer warrants that he/she is experienced and competent to use the equipment and has read the Hirer’s instruction manual and will abide by all conditions thereof.
          • The hirer sterilises and cleans the bike thoroughly upon receiving and prior to collection and return to the owner in line with COVID-19 sanitisation specifications.
          • All and any breakdowns/malfunction resulting from misuse or failure to use, service, maintain or store equipment in accordance with the manufacturer’s and the hirers guidelines and recommendations shall be repaired at the direction of the owner and the hirer shall immediately notify the owner of any such breakdown. Hiring charges shall continue to be payable notwithstanding equipment breakdown malfunction.
          • The hirer warrants that he/she has inspected and examined the equipment and the equipment is suitable for use/purpose to which the hirer intends to put it.
          • The owner shall not be liable to the hirer for any loss or damage suffered or sustained by the hirer or liability incurred by the hirer as a result of or connection with any breakage, malfunction of the equipment, delivery or pick up however caused. The hirer shall immediately notify the owner of any breakage/malfunction.
          • Change of address or telephone number should be notified immediately
          • No assignment of hire agreement. The hirer may not assign or transfer the equipment or this agreement and the hirer shall keep the equipment in the possession of the hirer and shall not authorize or permit the equipment to be in the possession of any other.
          • All hire equipment is delivered to the ground floor only. We do take equipment upstairs unless arranged prior to delivery, extra charges apply.

          Injury or damage to hirer or property: 

          • The owner shall not be liable for any personal injury loss or damage or other injury loss or damage caused by neglect, misuse, inadequate or improper maintenance, alteration, incorrect assembly or adjustment or use of the equipment contrary to manufacturer’s recommendation or in breach of any warranty or representation by the hirer contained in this agreement.
          • The hirer agrees to use the equipment at his/her own risk and agrees that the owner shall not be liable for any personal injury, loss or damage or other injury, loss or damage resulting from use of the equipment however caused. The hirer further covenants with the owner not to sue the owner or any associated person or entity or in relation to any personal injury, loss or damage or any other injury, loss or damage so caused or occurring.
          • Injury or damage to hirer or third person or property. The hirer and his/her immediate family are the only authorised person/s to use the equipment. Any person using the equipment shall do so at their own risk. The hirer indemnifies the owner against all personal injury, loss or damage or any other injury loss or damage, claims, costs expenses or the like by any third party as a result of use or arising out of or in connection with the equipment by any third party or any person whatever other than the hirer, with or without the consent or authority of the hirer.

          Applicable laws

           This agreement shall be governed by and construed in accordance with the law of the state of Victoria, Australia and any dispute or difference arising out of this agreement or any term or terms thereof shall be justifiable and adjudicated and determined by the Courts of the state of Victoria and not in or by the Courts of any other jurisdiction. In signing this agreement acknowledge that I have read and accepted the conditions and terms of this hire agreement.

          It is hereby agreed that the hirer will seek medical advice prior to the usage of the equipment, and that the hirer will not be entitled to a claim against the company for an injury resulting from not seeking such guidance prior to usage. The Hirer further acknowledges that while the functions and attributes of the equipment may be explained by the company to the hirer that in no way has the company its employees or agents recommend the suitability of this equipment for the hirer and that this advice needs to be acquired from a medical practitioner and the Hirer agrees to make no claims against the company resulting from the use of the equipment.

          It is hereby agreed that the hirer will ensure the equipment is in correct working order prior to the usage of the equipment, and that the hirer will not be entitled to a claim against the company for an injury resulting from not inspecting the equipment prior to use.

          The hirer warrants and undertakes that he will, in the event of moving to a new place of residence (or in the case of a company, to a new place of business), notify the company prior to such change, whereupon the company shall have the option to forthwith rescind this agreement and be entitled to immediate re-delivery of possession of the equipment.

          The hirer hereby warrants and undertakes that he will not move the equipment from the address of the hirer shown on the face of this document for a period in excess of seventy two (72) hours without having first obtained the consent of the company, in writing, prior to moving the said equipment.

          This agreement to hire may be terminated by the company at any time by notice in writing posted to the address of the hirer shown on the face of this document. The company shall be entitled to retake possession of the equipment immediately upon delivery of such notice in writing in the event of cancellation of this agreement by the company pursuant to this paragraph, the company undertakes to refund, on a pro rata basis, such proportion of the periodic hire rate as shall apply to the unused period of hire.

          In the event of the hirer being in default of payment of any hire charges, any other charges of fees or any condition hereof, the company shall be entitled to forthwith rescind this agreement without notice to the hirer and shall then be immediately entitled to retake possession of the equipment in the event of the cancellation by the company of this agreement pursuant to this paragraph, the hirer shall forfeit to the company any hire charges with respect to any unused period of hire. In the event that a collections agent is required to collect any outstanding payments, the fees for the collections agency will be passed onto the Hirer.

          The company shall be entitled to retain out any deposit paid by the hirer such amounts as the company may, in its discretion, decide shall be sufficient to compensate the company for any loss, damage, or inconvenience occasioned to the equipment or the company pursuant to this agreement.
