BODHI & RIDE – TERMS AND CONDITIONS
EFFECTIVE FOR ALL MEMBERSHIPS, SUBSCRIPTIONS AND CREDITS PURCHASED OR SIGNED UP FROM 21 April 2025
Bodhi & Ride is a boutique fitness studio in Victoria that offers innovative, full-body workouts on and off spin bikes, with classes led by instructors to inspire and motivate clients to connect mind and body through movement.
We offer unique, uplifting spin classes designed to challenge you physically and replenish you mentally.
Our aim is to provide a welcoming sanctuary from the outside world for all fitness and wellness levels.
You can become one of our exclusive tribe members by accepting the terms and conditions for our Premium Memberships, Bodhi At Home Subscriptions, Class Packs or Student Membership below.
If you are a new member of Bodhi and Ride, we welcome you to the Tribe with a reduced sign up cost of $50.00, which gets you 3 ride credits valid at all Studios, along with a $50 discount for the next purchase, along with free cycle shoe hire and sweat towel hire. This welcome offer only applies to permanent residents of Melbourne (proof of residence is required).
1. Interpretation
1.1. All figures referred to in these Terms and Conditions are inclusive of Goods and Services Tax (GST).
1.2. These Terms and Conditions incorporate all other Bodhi and Ride policies including:

1.3. Any statute, ordinance, code or other law includes regulations and other instruments under any of them and consolidations, amendments, re-enactments or replacements of any of them.
1.4. A reference to money is to Australian dollars, unless otherwise stated.
1.5. A time is a reference to Australia Eastern Daylight Time unless otherwise specified.
1.6. Headings are for convenience only and do not affect the interpretation of these Terms and Conditions.
1.7. A provision of these Terms and Conditions must not be construed to the disadvantage of a party merely because that party or its advisers were responsible for the preparation of the Terms and Conditions or the inclusion of the provision in these Terms and Conditions.
2. Definitions
“At Home Subscription”
means the subscription package referred to in clauses 3.1.6 to 3.1.7 of these Terms and Conditions, that has been purchased by the Member.
“Australian Consumer Law”
means Schedule 2 of the Competition and Consumer Act 2010 (Cth).
“Billing Period”
means Bodhi and Ride will bill the Member for Membership or Subscription 30 days in advance. The billing date will be taken as the date the Membership or Subscription commences, and in the event the billing date falls on a non-Business Day, the billing date will be taken as the next Business Day.
“Bodhi and Ride”
Means Bodhi and Ride Pty Ltd and includes all directors, officeholders, employees, agents, representatives and related entities.
“Bohdi Digital Service”
means services that are delivered over the internet or an electronic network.
“Business Day or Days”
means Monday through Friday from 8.30am to 5:00pm, other than Saturday, Sunday or a public holiday.
“Day or Days”
means a calendar day.
“Events”
means any exclusive, temporary, promotional or seasonal event or other such event that is held at a Bodhi and Ride Venue, or other location, that does not form part of Ride Classes.
“GST”
means the goods and services tax of Australia payable under A New Tax System (Goods and Services Tax) Act 1999, and any regulation made under that Act.
“Member”
means the person purchasing the Premium Membership to which these Terms and Conditions apply.
“Membership”
means the Premium Membership, or the Student Membership.
“Minimum Commitment Period”
Means six months from the date the Premium Membership commences, or one month from the date At Home Subscription commences.
“Pop-ups”
means any one off, or isolated event that is held at a Bodhi and Ride Venue, or other location, that does not form part of Ride Classes.
“Premium Membership”
means the membership package referred to in clauses 3.1.1 to 3.1.5 of these Terms and Conditions, that has been purchased by the Member.
“Programs”
means a Member's access to pre-recorded or live fitness classes, guided by trainers.
“Ride Classes”
means high intensity cardio training for 45 minutes on the bike with fast choreography – our signature Bodhi Track.
“Subscription”
means the Bodhi at Home Subscription.
“Subscription Period”
means the defined timeframe during which the Member has access to a service.
“Student Membership”
means the Membership described in clause 3.1.9.
“Studio”
means the Studio locations at:

“Workshops”
means any speciality workshop, training session, informational session, or other such event that is held at a Bodhi and Ride Venue, or other location, that does not form part of Ride Classes.
3. Memberships and Class Packs
3.1. We offer several Premium Memberships, Student Membership, At Home Subscriptions and Class Packs to suit your riding style:

• 5 rides per month
• $120.00/month ($24.00/Ride credit)
• Top up credits are available for $20/credit
3.1.2. Bodhi 8 Premium Membership
• 8 rides per month
• $155.00/month ($19.38/Ride credit)
• Top up credits are available for $20/credit
3.1.3. Bodhi 15 Premium Membership
• 15 rides per month
• $225.00/month ($15.00/Ride credit)
• Top up credits are available for $20/credit
3.1.4. Bodhi 15 Weekday Warrior Membership (Monday to Friday only)
• 15 rides per month
• $185.00/month ($12.33/Ride credit)
• Top up credits are available for $20/credit
3.1.5. Bodhi Unlimited Premium Membership
• Unlimited rides per month

3.1.6. Bodhi At Home Subscription
• Unlimited on-demand access to Bodhi At Home classes

3.1.7. Bodhi At Home Subscription + Bike Hire

• $80 delivery fee for the Bike
3.1.8. Workshops, Events, and Pop-Ups – Class Packs
• Single Credit: $35.00 for 1 Ride credit that expires 30 days after purchase
• Member Single - Ride: $20.00 for 1 Ride credit that expires 30 days after purchase. Members only
• Five Pack: $155.00 for 5 credits that expire 45 days after purchase
• Ten Pack: $289.00 for 10 credits that expire 90 days after purchase
• Twenty Pack: $499.00 for 20 credits that expire 180 days after purchase
• Fifty Pack: $1099.00 for 50 credits that expire 6 months after purchase
• One Hundred Pack: $1700.00 for 100 credits that expire 1 year after purchase
• Student Single Credit: $25.00 for 1 credit that expires 30 days after purchase
• Student Ten Pack: $199.00 for 10 credits that expire 90 days after purchase
3.1.9. Student Membership
3.1.9.1 10 rides per month
3.1.9.2 $175.00/month ($17.50/Ride credit)
3.1.9.3 Top up credits are available for $20/credit
3.1.9.4 Pausing is only allowed after the first two payments have been made.
3.2. Unused Ride credits are not refundable, and expire after a period of 30 days, unless a request for rollover is submitted. See Clause 11 for further information.
4. Premium Membership Benefits
4.1. Credits: Ride credits can be used for any Ride Classes, at all Studios.
4.2. Membership Ride Credits cannot be used for Workshops, Events, and Pop-Ups.
4.3. Booking: Each Studio provides a monthly booking window.
4.4. Guest Pass: Bring a friend for free once per month (on request).
4.5. Perks: Free cycle shoe hire, $1 sweat towel hire.
4.6. Discounts: 10% off studio merch, 50% off Bodhi at Home (on request).
5. Duration of Premium Membership, Student Membership and At Home Subscription
5.1. The Membership, or Subscription commences on the date the Membership, or Subscription is purchased.
5.2. Membership, or Subscription will apply for a minimum period of 6 months.
5.3. Membership, or Subscription will continue until such time as the Member terminates the Membership, or Subscription in accordance with clause 20 or 21 of these Terms and Conditions.
5.4. Class Packs are a single and limited usage Ride Credits.
6. Membership Payments
6.1. Membership, or Subscription and Class Pack fees are outlined in clause 3 of these Terms and Conditions.
6.2. Membership, or Subscription are billed monthly on the same date each Billing Period.
6.3. Payments are processed via direct debit or credit card (a valid card must be on file).
6.4. Members must ensure sufficient funds are in the nominated account and update nominated payment details at least 72 hours before billing.
7. Failed payments
7.1. In the event of a payment failure a $10.00 fee, for each day the Membership, or Subscription fees remain unpaid, is applied in addition to the monthly Membership, or Subscription fees.
7.2. In the event the Membership, or Subscription fees remain unpaid for a period of more than 21 days, Bodhi and Ride will treat the failure to pay as a cancellation of the Membership, or Subscription.
8. Membership Switches
8.1. Members are able to switch the purchased Membership, or Subscription once during the lifetime of the Membership, or Subscription, including the subsequently switched Membership, or Subscription.
8.2. Three business days notice is required of a switch.
8.3. The minimum period in clause 5.2 of these Terms and Conditions resets when the Member switches.
8.4. A $10.00 Membership or Subscription switch fee applies.

8.6. The Member must ensure they request the correct date of the switch as Bodhi and Ride can not switch a Membership, or Subscription on the day the Membership, or Subscription renews. For example, if the Membership, or Subscription renews on the 10th of every Month, please request the switch to be actioned on the 9th of every month (the day before it renews).
9. Membership Pauses
9.1. Members are only able to pause Premium Memberships or Student Memberships. At Home Subscriptions cannot be paused.
9.2. Two business days notice is required of a pause.
9.3. Limit: One Membership pause is permitted per Billing Period per financial quarter (for travel, illness, work commitments).
9.4. A $10.00 Membership pause fee applies.
9.5. When requesting a Membership pause, a date will be nominated for recommencement of the Membership. The maximum period allowed for a Membership pause is one billing period.
9.6. To pause a Membership, the Premium Membership Pause Request Form must be completed. This form is available here:

9.7. On request, Bodhi and Ride has the discretion to permit a Membership pause for longer than one billing period. The Membership Re-Pause Form must be completed ($10 admin fee applies). This form is available here:

9.8. Membership cannot be unpaused early or extended. For an extension, the Membership must unpause before requesting another pause.
9.9. While paused, Members cannot book classes. To attend a class during a pause, Members must purchase top up credits.
9.10. If a pause extends beyond a Billing Period, the Billing Date shifts to the date of the nominated recommencement ($10 administration fee applies).
9.11. A member is not permitted to pause a Membership for two consecutive months.
9.12. When a Member pauses a Membership, the Member will not be billed for that month and will not have Ride credits dropped into the account.
9.13. Pausing a Membership during the Minimum Term will result in extension of the Minimum Term by the period the Membership has been paused.
9.14. Membership can not be terminated while paused.
10. Cooling off period
10.1. Bodhi and Ride offer a cooling off period for Memberships and Subscriptions.
10.2. The cooling off period starts at the time the Membership or Subscription was purchased.
10.3. The cooling off period ends 48 hours after the cooling off period starts, however the Member waives any benefits available under the cooling off period if services are accessed in any way, including, but not limited to, using Ride credits.
11. Credit Rollover
11.1. Members may roll over to the next Billing Period up to four unused Ride credits obtained through the purchase of a Membership, or purchased as a top up credit.
11.2. A $10.00 Membership roll over fee applies.
11.3. Rolled over Ride credits expire after a period of 30 days from the date the roll over occurs, and cannot be extended.
11.4. The request must be submitted before the Billing Cycle, during which the Ride credits were obtained through the purchase of a Membership, or purchased as a top up credit, ends.
11.5. The request must be submitted before the Member's Billing Cycle ends. To roll over Ride credits, the Premium Membership Roll Over Request Form must be completed. This form is available here:

12. Membership Sharing
12.1. Premium Memberships can be shared with one other person upon request.
12.2. Student Memberships cannot be shared.
12.3. Credits purchased through the Welcome Offer are not shareable.
12.4. Class Packs are not shareable.
12.5. Benefits:
12.5.1. Book two spots in a class using shared credits.
12.5.2. Another person can book separately under the same Premium Membership.
12.6. Both users must agree to Membership Terms and Conditions.
12.7. A $10.00 Premium Membership sharing fee applies.
12.8. To share a Premium Membership, the Share Membership Request Form must be completed. This form is available here:

12.9. To stop sharing, the Member must notify Bodhi and Ride by email.
12.10. If more than two people share a Premium Membership, the Premium Membership may be suspended immediately.
13. Bring a Friend for Free (Once a Month)
13.1. Members are permitted to obtain one free guest pass per month.
13.2. Guest must be new to Bodhi and Ride, and not have previously held a Membership, Subscription, or Class Pack.
13.3. Two business days' notice is required to obtain a guest pass.
13.4. To obtain a guest pass, the Bring a Friend for Free Request Form must be completed. This form is available here:

14. Fee Increases & Terms Changes
14.1. Bodhi & Ride reserves the right to amend fees and terms.
14.2. Bodhi and Ride will provide at least 14 days' notice by the email address the Member nominated when creating the Membership or Subscription, or other email address notified to Bodhi and Ride in writing after the Membership or Subscription commences.
15. Premium and Student Membership, and Class Packs Only: Refunds, No-Shows & Late Cancellation
15.1. A 12-hour cancellation policy applies.
15.2. No refunds are available for missed or late-cancelled Ride classes.
15.3. If a Member cancels a Ride class more than 12 hours prior to the scheduled time, the Ride credit for the class will be refunded to the Member's account.
15.4. For Bodhi Unlimited Premium Membership Only: If a Member fails to give the required notice, and does not attend a scheduled Ride class, a $20 no-show fee applies. The fee will automatically be applied to the Member's account.
16. Premium and Student Membership, and Class Packs Only: Waitlist Terms
16.1. If the Member is placed on a waitlist, addition to the waitlist confirms the Member's spot.
16.2. If a spot opens, the Member will be automatically added and notified by email.
16.3. If you cannot attend a last-minute class, do not add yourself to the waitlist. See clause 15 for further information. However, this clause does not apply if the notice given to the Member of a spot becoming available is less than 24 hours.
17. Student Memberships Only
17.1. Student Members are required to email a copy of their student ID to home@bodhiandride.com.au, or present a copy in Studio, to confirm the Member is eligible for student pricing. Student pricing is for local students only. Bodhi and Ride do not accept international student IDs. Student memberships can only be paused after 2 months of payments have been received.
18. Bodhi at Home Subscriptions Only
18.1. Bodhi and Ride may add or remove Programs from the channel at any time.
18.2. The Member is responsible for obtaining Internet access and a compatible, Internet-connected device to stream and/or download Programs via Bodhi and Ride websites and applications. The quality of the Member’s viewing experience depends on a number of factors, including the Member’s viewing device and the quality of the Member’s Internet connection.
18.3. Bodhi and Ride makes no representations or warranties concerning:
18.3.1. The availability of Bodhi at Home for any particular device, operating system, or browser.
18.3.2. The continued support for a particular feature of Bodhi at Home.
18.3.3. The viewing quality of any Program.
18.3.4. That the Member will be able to view any Program uninterrupted or error-free.
18.3.5. The continued availability of any Program or the availability of a particular Program within a subscription channel.
18.4. In using the Bodhi Digital Service, the Member will not:
18.4.1. Scrape, reproduce, redistribute, sell, create derivative works from, decompile, reverse engineer, or disassemble content or any source code therein;
18.4.2. Attempt to circumvent any technical measures (including digital rights management) that we may employ;
18.4.3. Take any measures to interfere with or damage Bodhi at Home;
18.4.4. Use Bodhi at Home to transmit tortious, unlawful, infringing, and otherwise objectionable content;
18.4.5. Spam or harass any user;
18.4.6. Use any fraudulent, deceptive, or misleading practices;
18.4.7. Collect personal information about any users;
18.4.8. Engage in any commercial activities except as permitted by us; or
18.4.9. Engage in any illegal activities.
18.5. License to Programs: Subject to the terms herein, the Member has the right to stream and/or view Programs for the Member's personal entertainment purposes:
18.5.1. Programs that the Member has rented during the stated rental period;
18.5.2. Programs that the Member has purchased; and
18.5.3. Programs made available within a channel that the Member has subscribed to during the Subscription Period.
18.6. The Member is not permitted to resell streams or downloads, use any Program for any commercial purpose, redistribute or retransmit any Program, publicly perform or display any Program, or make derivative works from any Program.
18.7. If a Member downloads an application that Bodhi and Ride owns that operates on a third-party platform (e.g., iOS, Roku):
18.7.1. The Member has the right to use such app for their personal, non-commercial use on devices permitted by the platform operator;
18.7.2. As between Bodhi and Ride and the platform operator (but without creating any obligation by Bodhi at Home), Bodhi and Ride shall be responsible for the apps and their content and providing any warranty, support, or indemnification with respect to such apps as required by law;
18.7.3. The platform operator shall have the right to enforce the terms of this clause with respect to the Member’s use of the app.
19. Bodhi at Home + Bike Hire – ownership and return of equipment
19.1. The Member acknowledges that the Bodhi and Ride is providing the short term hire of an exercise bike. This short term hire does not confer any ownership rights of the exercise bike to the Member.
19.2. Free delivery and set up of the exercise bike is available for Members located in Inner Metropolitan regions of Melbourne. Additional charges may apply for deliveries and collections outside of this area. These charges will be discussed and agreed upon with Members prior to delivery.
19.3. If stairs or steps must be navigated during delivery or collection, we must be notified in advance. Additional charges may apply in such cases.
19.4. If Members are not satisfied with the exercise bike, Member may swap it at the discretion of Bodhi and Ride. Additional charges may apply for swaps.
19.5. At all material times Members must ensure the exercise bike is kept in a safe and secure place.
19.6. Members agree to use the exercise bike responsibly and in accordance with any instructions provided by Bodhi and Ride.
19.7. Members are responsible for any loss or damage to the exercise bike during the hire period, and Members may be charged for repairs or replacements as necessary.
19.8. Members must notify Bodhi and Ride immediately of any issues or malfunctions with the exercise bike, and Bodhi and Ride will provide a suitable solution as soon as possible.
19.9. Members agree to return the exercise bike to, or make the exercise bike available for collection by, Bodhi and Ride, with 5 business days of cancellation of the At Home Subscription.
19.10. Members must return the exercise bike in a cleaned and disinfected condition.
19.11. In the event of failure by the Member to return the equipment following cancellation of the At Home Subscription, Bodhi and Ride may enter on any property where the equipment is situated so as to take possession of same and the Member indemnifies Bodhi and Ride from all claims by any persons (including the Member) resulting from such entry and retaking of the equipment.
19.12. Bodhi and Ride reserves the right to refuse service or terminate the At Home Subscription if the Member is found to be in breach of these Terms and Conditions.
20. Premium Membership and At Home Subscription Cancellation
20.1. Cancellation is permitted in accordance with clause 10, during the cooling off period, without further liability.
20.2. In the event of waiver of the cooling off period, as per clause 10.3, or after the expiry of the cooling off period, cancellation may only occur after the Member has completed the Minimum Commitment Period.
20.3. To cancel a Membership or Subscription, a period of 3 weeks notice is required.
20.4. If a Membership or Subscription payment is due within the notice period, it must be paid before cancellation is processed.
20.5. A Membership cannot be cancelled while paused.
20.6. A Member may terminate the Membership or Subscription before the expiry of the Minimum Commitment Period if all payments and fees due up to the date of Minimum Commitment Period and termination notice are paid in full at time of cancellation request.
20.7. At the sole discretion of Bodhi and Ride, the liability for any outstanding payments and fees may be waived, or reduced.
20.8. To cancel a Membership or Subscription the Premium Membership Cancellation Form must be completed. This form is available here:

20.9. In the event of a failure to pay all payments and fees owing in accordance with these Terms and Conditions, or a failure to return any exercise bikes (for At Home Subscriptions), recovery action will be commenced against the Member.
20.10. Any legal fees, Court or Tribunal costs, and collection costs will be charged to the Member.
21. Termination or Suspension by Bodhi and Ride
21.1. Bodhi and Ride reserves the right to terminate the Membership, Subscription or Class Packs in any of the following circumstances:
21.1.1. The Member fails to comply with the Terms and Conditions.
21.1.2. The Member fails to comply with all other policies that incorporate with these Terms and Conditions.
21.1.3. If Bodhi and Ride reasonably believe that the Member has engaged in conduct that causes an unacceptable risk to the health, safety or wellbeing of any other Members or employees of Bodhi and Ride.
21.1.4. The temporary or permanent closure of Bodhi and Ride Venue.
21.2. In the event Bodhi and Ride believe it is necessary to terminate or suspend a Member’s Membership, Subscription or Class Packs, written notice will be given to the Member, with an opportunity to show cause as to why the Membership, Subscription or Class Packs should not be terminated or suspended.
21.3. In the event the Member cannot show cause why the Membership, Subscription or Class Packs should not be terminated or suspended, Bodhi and Ride will give notice to the Member stating the date of termination or, in the case of the suspension, the date the suspension will commence and end.
21.4. In the event of termination or suspension, all payments and fees owing in accordance with these Terms and Conditions, will become immediately due and payable and, for At Home Subscriptions, any exercise bike in the possession of the Member will be immediately returned to Bodhi and Ride.
22. Non-Disparagement
22.1. The Member agrees not to disparage Bodhi and Ride or make any statement or publication, whether oral or in writing, which does, or is likely to, bring Bodhi and Ride into disrepute or ridicule or which may otherwise adversely affect the reputation Bodhi and Ride.
23. Australian Consumer Law
23.1. Except to the extent required by any law, including the Australian Consumer Law, Bodhi and Ride make no warranties or representations about the fitness for purpose of the services provided under these Terms and Conditions.
23.2. WARNING UNDER THE AUSTRALIAN CONSUMER LAW AND FAIR TRADING ACT 2012
23.2.1. If a Member signs this form, the Member will be agreeing that their rights to sue Bodhi and Ride under the Australian Consumer Law and Fair Trading Act 2012 are excluded, restricted or modified in the way set out in clause 23, if the Member is killed or injured because the services provided were not in accordance with the statutory guarantees outlined below.
23.2.2. Under the Australian Consumer Law (Victoria), several statutory guarantees apply to the supply of certain goods and services. These guarantees mean that the supplier named in these Terms and Conditions is required to ensure that the recreational services it supplies to the Member:

are rendered with due care and skill; and
-
are reasonably fit for any purpose which the Member, either expressly or by implication, make known to Bodhi and Ride; and
-
might reasonably be expected to achieve any result the Member has made known to Bodhi and Ride.
23.2.3. Under section 22 of the Australian Consumer Law and Fair Trading Act 2012, the exclusion of these statutory guarantees is brought to the Members attention by this clause 23.
23.2.4. NOTE: The change to the Members rights, as set out in this clause 23, does not apply if the Members death or injury is due to gross negligence on Bodhi and Ride’s part. Gross negligence, in relation to an act or omission, means doing the act or omitting to do an act with reckless disregard, with or without consciousness, for the consequences of the act or omission. See regulation 5 of the Australian Consumer Law and Fair Trading Regulations 2012 and section 22(3)(b) of the Australian Consumer Law and Fair Trading Act 2012.
24. Dispute Resolution
24.1. If there is a dispute between the parties arising out of or in connection with these Terms and Conditions, the parties must comply with this clause 24. Unless a party has complied with the procedures in this clause 24, the party may not commence legal proceeding to resolve any dispute.
24.2. A party claiming that a dispute has arisen must notify the other party in writing giving details of the dispute. The parties must, for a period of 10 Business Days after issue of notice of the dispute, use their respective reasonable efforts and act in good faith to negotiate settlement of the dispute.
24.3. If the dispute is not settled within the period described in clause 24.2, each party agrees that legal proceedings may be commenced to resolve the dispute.
24.4. Nothing in this clause 24 prevents a party from seeking urgent injunctive or similar interim relief from a Court.
24.5. Despite the existence of a dispute, each party must continue to meet their obligations under these Terms and Conditions, unless the Membership or Subscription has expired or terminated.
25. Force Majeure
25.1. Bodhi and Ride shall not be liable to the Member for any breach of its obligations or termination under these Terms and Conditions arising from causes beyond its reasonable control, including, but not limited to, fires, floods, earthquakes, epidemic, pandemic such as COVID-19, volcanoes and other Acts of God, terrorism, strikes, delay caused by transport disputes, failure to provide a course caused by a death in the instructor’s family, illness of the instructor, Government edict or regulation (Force Majeure Event).
25.2. If a Force Majeure Event impacts the services provided by Bodhi and Ride, Bodhi and Ride will make reasonable efforts to reschedule the services to a later date. If the services are unable to be rescheduled to a suitable date, Bodhi and Ride reserves all rights to terminate the Membership, Subscription or Class Packs immediately.
26. Severability
26.1. If any clause, or part thereof, is held to be unenforceable then the clause or part of the clause, will be severed from these Terms and Conditions and the remaining provisions of these Terms and Conditions will continue to have full force and effect.
27. Jurisdiction of Law
27.1. The laws of Victoria govern these Terms and Conditions.
